行政公益诉讼起诉期限规范适用与制度构建
On the Normative Application and Institutional Construction of the Prosecution Period in Administrative Public Interest Litigation

摘要
行政公益诉讼制度自2015年实施以来,无论是试点期间还是现行法律规范均未对起诉期限作出规定.关于行政公益诉讼起诉期限的规范适用,目前学界与实务中主要存在两个争议.其一是行政公益诉讼是否适用起诉期限制度,其二是行政公益诉讼能否适用《行政诉讼法》中关于起诉期限的相关规范.与此同时,通过对实践中行政公益诉讼起诉期限法律适用分析,发现存在忽视行政公益诉讼的起诉前提、混淆"依申请"与"依职权"、对行政机关回复检察建议书性质认定错误等问题.行政公益诉讼起诉期限制度的构建,应做到与现有诉前程序及起诉条件的融洽衔接,针对案件类型的差异化在起算点、期间长度等方面分别设置,同时,应从制度内外两个层面对起诉期限的后果进行设置.
Abstract
Since the implementation of the administrative public interest litigation system in 2015,neither the pilot period nor the cur-rent legal norms have stipulated the prosecution period.There are currently two main controversies in academia and practice regarding the standardized application of the litigation period for administrative public interest litigation.One is whether the administrative public interest litigation should be subject to the prosecution deadline system,and the other is whether the administrative public interest litiga-tion can be subject to the relevant regulations on the prosecution deadline in the Administrative Litigation Law.At the same time,through the specific application of the law on the prosecution period of administrative public interest litigation in practice,it has been found that there are problems such as neglecting the prosecution premise of administrative public interest litigation,confusion between"based on application"and"based on authority",and incorrect determination of the nature of administrative agencies'response to procuratorial proposals.The construction of the litigation period system for administrative public interest litigation should achieve a har-monious connection with the existing system's pre litigation procedures and litigation conditions.The starting point and duration should be set separately based on the differences in case types.At the same time,the consequences of the litigation period should be set from both internal and external aspects of the system.
