Analysis of the Scope of the Exercise of the Administrative Punishment Power of the"Town(Township)and Street":Centered on the Article 24 in Administrative Punishment Law
The Article 24 of the Administrative Punishment Law establishes"the system of administra-tive punishment power moving down".However,this clause does not specify the scope of the punishment power of the grassroots government.From the perspective of the construction of the government by law,the scope of the punishment power of the grassroots government must be based on the premise of the sub-ject qualification of administrative punishment and determined in the way of authorization.From the stand-ard value,the scope of the downward punishment power is beneficial to improve the level of the rule of law government construction,because it establishes the administrative subject status of the grassroots govern-ment,confirms the scope of the exercise of punishment power of grassroots government,ensures the standardization of the exercise of punishment power of grassroots government.
