摘要
用能权是我国特有的一项新兴权利,是实现能耗总量和强度"双控"目标的重要手段.对于用能权的概念,可以从词义、规范以及学理渊源追溯.目前现有的概念缺乏上位法依据,与用能权指标混用,且法律属性不明.霍菲尔德权利理论是分析法律概念的有效工具.通过霍菲尔德权利理论拆解用能权的八个权利要素,既能重构用能权的概念,也能明晰用能权的权利结构.
Abstract
The right to use energy is a unique new right in China,and it is an important mean to achieve the goal of"double control"of total energy consumption and intensity.The legal con-cept of the right to use energy can be traced from its meaning,norms and theoretical sources.At present,the existing concept lacks the basis of upper law,and is mixed with the index of energy use right,and the legal attribute is unclear.Hofeld's theory of rights is an effective tool to analyze legal concepts.By deconstructing the eight elements of the right to use energy,we can define the legal concept of the right to use energy and clarify the right structure of the right to use energy.
