Concealed Evidence:Concept, Function and Application
Concealed evidence is a kind of appellation for a special type of evidence in the practical ifeld. From the point of view of information content, concealed evidence contains hidden information, that is, the hidden details of the case; from the performance form, in addition to confession, the concealed evidence can be any other legal evidence of the kind of performance. The function of concealed evidence is mainly relfected in the aspects of veriifcation and reinforcement of confession, especially in the process of “Confession to Proof” and “Proof to Confession”. Concealed evidence can also effectively deal with the confession. We should pay attention to collecting the concealed evidence comprehensively and normatively by using it, and obtaining the full confession of the hidden details, strictly conserved concealed evidence and details secret. It should also be noted that the concealed evidence must be conifrmed by other evidence, guarding against scapegoats may appearing in cases.
