新时代法学研究生案例教学模式的路径转型

摘要
我国传统法学研究生案例教学模式欠缺对学生问题意识、思辨意识的培养,教师主导的课堂模式不利于学生自主意识培养,也无法与法律职业素养养成相衔接,因而传统法学研究生案例教学模式亟待改革.从域外经验看,德国的鉴定式案例教学与美国的法律诊所教学受到广泛推崇,其中,鉴定式案例教学模式可克服我国传统案例教学模式的缺陷,为我国法学研究生案例教学所改造吸收.
Abstract
The traditional case teaching mode of law graduate students in China lacks the cultivation of students'consciousness of problems and critical thinking,and the teacher-led classroom mode is not conducive to the cultivation of students'consciousness of autonomy,nor can it be connected with the legal profession,so the traditional case teaching mode of law graduate students needs to be reformed.Based on the foreign experience,the German style and the American style law clinic teaching are widely respected.Among them,German case teaching model can overcome the defects of traditional case teaching in our country,and be reformed and absorbed by the case teaching of law graduate students in our country.
