Economic Law Idea Analysis and Institutional Construction of Data Security Governance
Data security governance should ensure that data is constantly in a state of adequate protection and legal use.Data security governance should be carried out in two governance areas,data management security and data circulation security.Weak personal information management,improper use of data and data competition are the main problems of data security governance at present,which not only reduces the overall level of data protection and use,but also harms the legitimate rights and interests of the relevant entities.Given the different security harms or risks faced by different types of data elements,governance methods should be targeted.The idea of economic law can provide an effective legal basis for data security governance.In order to form a data security legal system that is compatible with reality,collaborative and effective,it is imperative to expand the scope of personal information protection subjects and strengthen the responsibilities of personal information protection subjects under the idea of substantive fairness,coordinate and improve the legal rules and self-regulatory rules of corporate data circulation under the idea of orderly competition and unify the rules of public data management and openness under the idea of risk prevention.
