In the era of algorithms,various aspects of information about workers are digitized,and al-gorithms directly or indirectly affect the rights and interests of workers,and this impact is not easily per-ceived by workers.Compared with employers,workers are already in a relatively disadvantaged position.With the increasing application of algorithms in the field of labor employment,algorithm technology repli-cates and extends the discrimination in employment in real society through scoring and even automated deci-sion-making.Workers are subjected to discriminatory evaluations by algorithms due to factors such as their health status,family burden,and gender,and their rights and interests are infringed upon.The use of al-gorithmic technology in the process of employment poses a challenge to the equal employment rights of workers and has an impact on the existing legal system for protecting the equal employment rights of work-ers.It is necessary to improve the algorithm use procedures of employers,reduce the burden of proof for workers who suffer from algorithm discrimination through the reversal of the burden of proof,promote the transformation of regulatory models for algorithmic labor employment applications,jointly create an envi-ronment against algorithmic labor employment discrimination in the digital era,and promote the realization of equal employment rights for workers.
