摘要
新技术经济范式催生新就业形态,青年劳动者是新就业形态中的主要从业群体.现行社会保障制度的不足凸显构建适宜新就业形态青年劳动者社会保护体系的紧迫性.社会风险规避的需要、社会公平保障的需要与社会权利实现的需要是构建新就业形态青年社会保护体系的基本理论考量.当前构建新就业形态青年劳动者社会保护体系主要面临着劳动关系认定难的资格困境、平衡劳资关系难的维权困境与政府劳动监管难的治理困境.新就业形态青年劳动者社会保护体系可以分为风险管理型政策、社会投资型政策与社会融入型政策.新时代构建适应新就业形态青年劳动者社会保护体系可以从科学厘定劳动关系认定标准、建立顺畅劳动关系协调机制与推进政府数字监管能力建设等方面入手.
Abstract
The new technological and economic paradigm has given rise to new employment forms,and young workers are the main working groups in these new employment forms.The deficiencies of the cur-rent social security system have highlighted the urgency of constructing a suitable social protection system for young workers in new employment forms.The needs for social risk aversion,social fairness protection,and social rights realization are the basic theoretical considerations for constructing the social protection sys-tem for young people in new employment forms.Currently,the construction of the social protection system for young workers in new employment forms mainly faces the qualification dilemma of difficult identification of labor relations,the rights protection dilemma of difficult balance of labor-capital relations,and the gov-ernance dilemma of difficult government labor supervision.The social protection system for young workers in new employment forms can be divided into risk management policies,social investment policies,and so-cial integration policies.In the new era,to construct a social protection system suitable for young workers in new employment forms,we can start from aspects such as scientifically defining the identification stand-ards of labor relations,establishing a smooth labor relations coordination mechanism,and promoting the construction of the government's digital supervision capabilities.
