3D Marine Cadastre:Multiple Marine Rights with Case Studies
The developments and utilizations of sea area in China has gradually transformed from a single parcel develop-ment to a multi-layer three-dimensional development.How-ever,two-dimensional marine cadastre management cannot clearly define the different right status of each vertical layer of sea surface,water body,seabed and subsoil,and cannot clear-ly reflect 3D right boundaries and spatial position relationships of sea activities.Nor can it meet the needs of spatial manage-ment of sea area for 3D stratified developments.Current re-searches on the right to use sea areas mainly focuses on its le-gal nature,market mechanism and stratified limitation method lack of actual detail cases to illustrate the 3D stratified right to use sea areas from the perspective of 3D marine cadastre.This paper analyzes the necessity and feasibility of establish-ing the marine rights by 3D cadastre,puts forward the view of establishing the right of sea area by layers based on the space and functional use of sea area,and analyzes the case of the overlapping sea area between Zhuhai Bridge project and Zhu-hai tunnel project and the spatial demarcation of Shenzhen Bay in Guangdong Province.Through case analysis,the 3D strati-fied rights of sea area use rights plays an important role in the expression of 3D rights boundaries and spatial location rela-tions of sea use activities,the definition of marine use subjects under the background of multi-jurisdiction system,and the re-finement of marine space,which helps to solve disputes over marine use rights of and improve the level of 3D refined ma-rine management.
