Research on the special protection of sensitive personal information in the crime of infringing citizens'personal information
In the era of big data,sensitive personal information is directly linked to the safety of citizens'personal and property rights and is vulnerable to infringement,thus it requires special protection.In recent years,the regulation of the special protection of sensitive personal information in the crime of infringing on citizens'personal information has experienced a process from scratch to existence,from existence to perfection,from coarse to fine,and thus formed relatively complete protection rules of sensitive personal information classification,strict protection rules and flexible protection rules.The scope and classification of sensitive personal information in the crime of infringing on citizens'personal information can be appropriately judged different from the Personal Information Protection Law based on the principle of independence of the interests of criminal law and protection law.The differentiated protection mode between highly sensitive personal information and law sensitive personal information in the crime of infringing on citizens'personal information should be continued;the existing quantitative standards of highly sensitive personal information and low sensitive personal information should not be adjusted;the existing types of highly sensitive personal information should not be increased,and the judicial determination of highly sensitive personal information should adhere to the substance standard and strictly judge with caution.Following the implementation of the Personal Information Protection Law,it is essential to maintain the intensity and consistency of the criminal law in protecting sensitive personal information.Efforts should be focused on the strict enforcement of the Personal Information Protection Law and other pre-existing statutes to enhance the overall efficacy of legal protection for sensitive personal information.
