The Antitrust Law Regulation of Algorithm Collusion
Algorithm collusion is regulated by antitrust law, however the complexity of algorithms and monopolistic behaviors lead to many difficulties in using antitrust law to regulate such behavior. In terms of illegality,it is difficult to define subjective intentions, contracted behaviors and consequential damagess. In terms of accountability,it is difficult to clarify the subjects and distribute responsibilities. In terms of anti-monopoly supervision, there is insufficient regulation. In order to effectively regulate algorithm collusion,it is necessary to make full use of indirect evidence, comprehensively evaluate consequential damages, clarify subjects of responsibility and principle of distribution, reasonably define algorithm transparency and establish an effective supervision mechanism in the framework of antitrust law.
