摘要
数字经济时代,围绕企业数据保护的具体制度设计存在两种主要争议:一是认为围绕物权制度进行设计;二是认为以知识产权制度为基础来构建.但数据的无形性、信息属性等特性,以及激励创新性数据挖掘的目的,让数据天然地更适合知识产权保护模式.因此,首先明确企业数据的界定现状及特征,探究其内在特征和保护偏好;其次比较分析企业数据与知识产权保护客体之间的异同,从理论上证成其知识产权保护路径的正当性和可行性;最后明确实践中企业数据的知识产权保护困境,并探寻专门的数据知识产权保护路径.
Abstract
In the era of digital economy,there are two main controversies regarding the specific institutional design of enterprise data protection:one is designed for the property rights system,and the other for intellectual property system.However,the intangible and informational properties of data,as well as the purpose of stimulating innovative data mining,naturally bring it closer to the mode of intellectual property protection.Therefore,first of all,the definition status and characteristics of enterprise data should be clarified in order to explore its inherent characteristics and protection preferences.Secondly,compare and analyze the similarities and differences between enterprise data and intellectual property protection objects,and theoretically prove the legitimacy and feasibility of their intellectual property protection paths.Finally,based on intellectual property protection dilemma of enterprise data in practice,explore specific paths for data intellectual property protection.
