算法解释权规制困境与纾解——基于双向驱动型算法解释工具的分析

囿于算法固有的黑箱性、技术中立性及潜在的不确定性,传统算法解释权在对抗算法妨害问题上显得捉襟见肘,且在技术上也显现出可解释性难题,在理论和实践中均陷入困顿和颦蹙的局面.双向驱动型算法解释工具,在保留传统算法解释权合理内核的基础上,创造性地具备了主体多元的交互特质,能够激励多元主体发挥优势,实现高效协同的算法共治,开拓规制算法治理困境的创新思路.在规则优化层面,可通过有机融合算法解释和算法审查、细化算法解释规则、塑造平台合规体系等举措,依托动态的透明化路径来完善算法治理机制,最终实现协同共治下治理制度的范式革新.
The Dilemma and Relief of the Regulation of Algorithm Interpretation——Based on the Analysis of Bi-directional Driving Algorithm Interpretation
Due to the inherent black box,technical neutrality and potential uncertainty of algorithms,traditional interpretation right of algorithms is coming out at the elbows to resist obstruction of algorithms,and also poses interpretability problems in technology,which is in a difficult and awkward situation in terms of both theory and practice.On the basis of retaining the reasonable core of the traditional algorithm interpretation right,a bi-directional driving algorithm interpretation tool creatively has the interactive characteristics of multiple subjects,which can inspire multiple subjects to give full play to their advantages,fulfill efficient and collaborative algorithm co-governance,and open up innovative ideas for regulating algorithm governance dilemmas.At the level of rule optimization,we can organically integrate algorithm interpretation and algorithm review,refine algorithm interpretation rules,shape platform compliance system and improve algorithm governance mechanisms through dynamic and transparent paths,and finally realize the paradigm innovation of governance system under collaborative co-governance.
