Research on data personality rights in the context of metaverse
With the in-depth development of virtual space and data interaction technology,the changes in the attributes of personality data have triggered a divergence between the"equity theory"and the"rights theory"in data ownership theo-ry,which has led to current practical problems such as data migration,information inflation,and data value imbalance.Through a comparative study of the aforementioned two theories,it is found that compared to rights,personality data rights have problems such as limitations on ownership and the lack of core legal interests.Data personality rights meet the basic requirements of three elements:subjectivity differences,legislative comparison,and independent rights certification.The boundary between data personality rights,privacy rights,and personal information rights can also be ex-plored from the perspective of the"rights behavior"regulatory model.In the current stage of technological development,the relationship between data personality rights and traditional personality rights should be coordinated from two aspects:subject regulation and field breakthrough.Taking data personality rights as a beneficial supplement to specific personality rights norms,in the future when virtual space technology develops to the stage of personality mimicry and local space self-control,it will gradually replace some specific rights such as privacy rights and personal information rights in the virtual space.At the same time,in terms of the legal relationship of data personality rights,it is also necessary to divide positive and negative powers and combine data scenario application flow diagrams to construct the content of their basic rights and systematic obligations.Then,around the construction of a personality data industry system,it is necessary to gradually explore and establish a personality data classification and grading system,a personality database system,and a data banking system represented by personality data business,in order to achieve the value concept of personality data stand-ardization,security,and enjoyment.It is expected to build a personality data protection regulatory system in the context of a diverse virtual space data information interaction platform.
