Incorporating core socialist values into algorithmic governance for intellectual property on e-commerce platforms
With the rise of new technologies such as big data,artificial intelligence,and cloud computing,algorithms have emerged as a novel means for governing intellectual property(IP)infringement on e-commerce platforms.This gov-ernance primarily manifests in two forms:algorithm detection mechanisms and algorithm notification mechanisms,which,despite being based on the same technological principles,represent"two sides of the same coin".However,the aliena-tion and misuse of algorithmic technology can lead to ethical risks in IP governance on e-commerce platforms.Potential pitfalls exist at three stages:model establishment,data input,and output results.Additionally,factors such as cost con-siderations,evasion of infringement liabilities,and profit incentives can motivate entities to misuse algorithms.Integrating core socialist values into the algorithmic governance of IP on e-commerce platforms is a necessary requirement for combi-ning the rule of law with moral governance,and is a crucial step toward modernizing China's legal framework.Using a technical ethics approach that combines both intrinsic and extrinsic perspectives,the integration of core socialist values with algorithmic governance can be distilled into macro-level and micro-level focal points:a macro focus on the holistic governance of IP on e-commerce platforms,and micro focuses on promoting"technology for good",prohibiting the abuse of intellectual property,and enhancing platform autonomy.These correspond to values of rule of law,civilization and jus-tice,integrity,freedom,and democracy.Adhering to the principle of"technology itself-technology application",this paper proposes several recommendations for algorithm program design across the three stages,including incorporating public interest considerations,establishing information-sharing mechanisms,and setting up an algorithmic"counter-noti-fication"process.Furthermore,regarding the limits of algorithm application,it is currently suggested to maintain the non-mandatory nature of algorithm filtering and to improve governance measures for malicious notifications.
