民事案件异步审理:价值、问题与规则构建

摘要
推进异步审理模式不断探索电子诉讼应用深度的改革,不仅符合现代民事诉讼制度的发展逻辑,也顺应科技融合司法的社会发展规律.异步审理模式具有程序正当性且满足时代需求.通过对异步审理规范以及司法实践运行情况的考察,梳理当下异步审理的适用存在定位不明和条件范围不统一的问题;提出应当立法明确异步审理模式的定位,使其成为独立于传统诉讼和线上同时审理的一种新型审判方式;建议司法实务应当统一适合异步审理模式的诉讼程序范围、案件类型范围、法院范围以及适用条件.
Abstract
Promoting the asynchronous trial model,while continually exploring the depth of electronic litigation applications,not only aligns with the development logic of modern civil litigation systems but also conforms to the social development trend of integrating technology with the judiciary. The asynchronous trial model possesses procedural legitimacy and meets the demands of the times. By examining the regulations and judicial practices of asynchronous trials,the study identifies issues such as unclear positioning and inconsistent conditions and scope in its current application. The paper proposes that legislation should clearly define the positioning of the asyn-chronous trial model,establishing it as a new type of trial independent of traditional litigation and simultaneous online trials. It is recommended that judicial practice should unify the procedural scope,case type range,court range,and application conditions suitable for the asynchronous trial model.
