高校教师权利救济的路径与困境——基于212份裁判文书的分析

教师权利救济是教师依法维护自身权利的有效路径.调解、申诉、仲裁、行政复议与诉讼等教师权利救济制度相互衔接构筑起教师权利救济网络.教师部分权利救济的缺失使得教师的权益出现"有权利,无救济"的状况.在教师权利救济的过程中,救济机构的不作为以及争议处理过程中的程序履行不当,使教师权利受到二次侵害;教师的举证能力与意识的不足也使得教师处于救济的不利地位.为保障教师法定权利的顺利实现,应完善各类教师救济制度的衔接互补,填充教师权利救济的真空地带;引入新闻媒体等社会监督,发现并制止相关机构不作为;同时强化相关工作人员的法定程序意识,避免救济机构乱作为;教师自身更要加强自身举证智慧,避免在权利救济的过程中无据可依.
Challenges and solutions in remedies for university teachers'rights:an analysis of 212 judgment documents
Remedies for teachers'rights are an effective way for teachers to legally safeguard their own rights.The system of teacher rights relief includes systems such as mediation,appeals,arbitration,administrative review,and litigation,which are interconnected to form a network of remedies for teachers'rights.However,the lack of partial remedies for certain rights has led to a situation where teachers"havie rights,without remedies".In the process of keeking remedies,the inaction of remedy institutions and improper procedural performance in dispute resolution subject teachers'rights to secondary infringement.Teachers'insufficient ability and awareness of teachers in providing evidence also puts them at a disadvantage in seeking remedies.Therefore,to ensure the smooth realization of teachers'legal rights,it is necessary to improve the interconnection and complementarity of various teacher remedy systems,and fill the vacuum of teacher rights remedies;social supervision,such as news media,should be introduced to identify and prevent inaction by relevant institutions.At the same time,the awareness of legal procedures among relevant staff should be strengthend to avoid arbitrary actions by remedy institutions.Teachers themselves need to ehnance their own wisdom in providing evidence and avoid being baseless in the process of seeking remedies.
