摘要
随着人工智能被广泛应用于数据隐私、知识产权、劳动关系和市场竞争等重点领域,现有的经济法规制难以应对该市场化挑战.聚焦人工智能技术发展对经济法的影响及应对路径,从构建"促进——限制"双向并用的经济法规制框架、强化跨部门监管机制、完善风险评估措施以及借鉴国际经验等方面,提出人工智能时代经济法完善的具体策略,以保障市场公平与创新,推动人工智能经济的可持续发展.
Abstract
With AI widely applied in key areas such as data privacy,intellectual property,labor rela-tions,and market competition,existing economic regulations face challenges in addressing these market-driven issues.Focusing on the impact of Artificial Intelligence(AI)development on economic law and cor-responding regulatory strategies,this study proposes specific strategies to improve economic law in the AI era,including the establishment of aregulatory framework that utilizes both"promotion and restriction",the strengthening of inter-departmental regulatory mechanisms,the refinement of risk assessment meas-ures,and the integration of international experiences.These measures aim to safeguard market fairness and innovation,fostering the sustainable development of the AI-driven economy.
