Research on the Current Situation and Governance Path of Archives Service Outsourcing Disputes:Take 139 Judgment Documents as Research Samples
Archives service outsourcing has become a new service industry.The judicial disputes about archives service outsourcing deserve attention.Based on the analysis of 139 cases of archival service outsourcing disputes accepted by the court from 2008 to 2022,this paper finds that the number of archival service outsourcing disputes is rising in a fluctuating manner,the geographical distribution is uneven,the court level is moving down,and the types of cases involve civil,criminal,administrative and other fields.The operability of laws and regulations on archival service outsourcing is weak,the archival authorities pay less attention to security and risk control,the administrative enforcement level of the outsourcing of archival services needs to be improved,the administrative law enforcement and criminal justice of archival service outsourcing are not well connected,and the legal awareness of both sides of the contract is insufficient.In the future,it is necessary to optimize the legislative guarantee of archival service outsourcing,improve the legal risk management and supervision,improve the law enforcement level of archival service outsourcing,ensure the smooth connection between administrative law enforcement and criminal justice of archival service outsourcing,and strengthen the legal awareness of contract subjects.
