The Normative Approach to the Rule of Law in Archival Governance:From"Soft Law and Hard Law Separation Governance"to"Soft Law and Hard Law Mixed Governance"
The rule of law in archival governance is an important requirement for improving archival governance capacity and level of governance in the new era.Although the"law"emphasised in the rule of law in archival governance mainly refers to the system of archival laws and regulations centred on the new Archives Law,society itself has nurtured a large number of soft law norms for self-governing archives,which also play an important role in the process of archival governance.Under the paradigm of"hard law-soft law"legal system,the single governance model of hard law and soft law as well as the soft law and hard law separation governance can no longer meet the current needs of the archival industry,and the soft law and hard law mixed governance has become the ideal model for the rule of law in archival governance.The hybrid model of soft and hard governance can give full play to the respective governance advantages of hard and soft law while making up for the functional deficiencies of the other,thus achieving a complementary system that is conducive to the modernisation and development of Chinese-style archives.It is urgent to standardize the rule of law in China's archival governance and realize the paradigm shift from"soft law and hard law separation governance"to"soft law and hard law mixed governance".
