Research on the Right Conflicts and Solutions of Archives Ownership in China
Following the research logic of"what""why"and"how",in this paper the author uses the literature research method,case analysis method,text analysis method and expert interview method to carry out research.From the macro,meso and micro levels,the author divides the types of the conflicts of the ownership rights of archives in China,and summarizes the current pain points;The legislative reasons that lead to the conflicts of rights including:the legislators emphasize instrumental rationality,the legal vacancy of archives ownership,the lag of the law of archives ownership,and the poor operability of existing laws;The targeted solutions include:optimizing the legislative concept of archives ownership,filling the legal gap of archives ownership,dynamically updating the law of archives ownership,and enhancing the operability of existing laws.
