A Study on the Social Insurance Participation of Labor Groups in New Business Forms
With the rapid development of new forms of employment,the number of new business practitioners in China has surged.How to promote such practitioners to participate in social insurance has become an urgent problem that needs to be solved.In 2021,the Ministry of Human Resources and Social Security jointly issued the Guiding Opinions on Safeguarding the Labor Security Rights and Interests of Workers in New Forms of Employment,dividing new types of workers into three categories and adding the labor form of"not fully in line with the established labor relationship situation",opening a new chapter in the protection of labor relations in new forms of social security.In recent years,governments in various regions of Chi-na have gradually relaxed their social security policies for new types of workers,ac-tively exploring and practicing ways to improve social security benefits and rights.However,they still face problems such as a lack of experience in dividing labor rela-tions,inertia in social security payments among workers in new formats and new e-conomic organizations,high payment pressure,cumbersome procedures for trans-ferring and continuing social security,narrow coverage,and difficulty in carrying out rights protection work.The paper is based on the"labor triad"and analyzes and constructs a social security participation path for new types of labor groups invol-ving various entities such as the government,workers,and employers.It proposes to improve the top-level design of labor relations division suitable for flexible employ-ment personnel in new types of industries as soon as possible;Eliminate the inertia of workers in participating in insurance and reduce payment pressure;Optimize the transfer and continuation procedures of social security,and improve the accuracy of insurance coverage expansion;Addressing policy,payment incentives,and adverse selection issues in the social security system;Implement regulatory policies and provide policy recommendations for safeguarding rights.
