摘要

近年来,中小学教师教育惩戒和教育惩戒权受到了广泛关注.教育惩戒在维持课堂秩序中发挥着举足轻重的作用,已经成为教师教学不可或缺的手段.在这种背景下,教育部颁布了《中小学教育惩戒规则(试行)》,首次以官方文件明确了教师的教育惩戒权.但是有研究发现当前我国中小学教师教育惩戒仍然面临着很多现实困境,与预期目标相距甚远,主要表现为惩戒缺少教育性、教师对此认同度不高、教育惩戒尺度难以把握、教师合法权益难以保障等.建议从完善相关法律法规、健全学校管理体系、聚焦教师自身培养、健全信息公开制度等多方面进行改进,推动教育惩戒工作"落地开花".

Abstract

In recent years,elementary school teachers'educational discipline and educational disciplinary rights have received widespread attention.Educational discipline plays a pivotal role in maintaining classroom order and has become an indispensable means of teaching for teachers.In this context,the Ministry of Education has promulgated the"Rules for Punishments in Primary and Secondary School Education(for Trial Implementation)",which for the first time clarifies teachers'educational disciplinary rights in official documents.However,some studies have found that currently,primary and secondary school teachers in China still face many practical dilemmas,which are far from the expected goals.The main manifestations are:the lack of educational nature of punishment,the low degree of recognition of teachers,and the scale of educational punishment is difficult to grasp.It is difficult to safeguard the legitimate rights and interests of teachers.It is recommended to amend the relevant laws,improve the school management system,concentrate on the cultivation of teachers'quality,and strengthen the information disclosure system,so as to promote the implementation of education punishment.
