区块链智能合约应用中的刑事风险及其应对

随着区块链技术的快速发展,以智能合约为载体的犯罪正呈现多元化.分布式账本的"去中心化"风险与合约代码的"转化"风险,产生了以智能合约为工具的犯罪;非对称算法的"私钥"风险,产生了以智能合约为对象的犯罪;自动执行的"不可逆"风险,产生了以智能合约为空间的犯罪.为了应对上述风险,需要从计算机技术与刑法理论协同推进.技术方面,谋求"完全匿名"到"可控匿名"的去中心化蜕变;实现"完全不管"到"必要监管"的平台义务转换;完善合约代码的堵漏机制.刑法理论方面,在客观归责层面引入行为共同说,并全面承认片面的共犯理论;确定私钥、以太币的虚拟财产属性;借鉴实质预备犯理论,作为处罚智能合约预备阶段的依据.
Criminal Risks and Countermeasures in the Application of Blockchain Smart Contract
With the rapid development of blockchain technology,crimes based on smart contracts are becoming diversified.The"decentralization"risk of distributed ledger and the"transformation"risk of contract code have led to crimes using smart contracts as tools.The"private key"risk of asymmetric algorithm leads to the crime of taking smart contract as the object.The"irreversible"risk of automatic execution produces a crime with smart contract as the space.In order to deal with the above risks,we need to integrate computer technology and criminal law theory.In terms of technology,it is necessary to seek the decentralizing transformation from"complete anonymity"to"controllable anonymity",transform platform obligations from"complete disregard"to"necessary supervision"and improve the plugging mechanism of the contract code.In terms of criminal law theory,it is essential to introduce the theory of joint act,fully recognize the one-sided accomplice theory,deter-mine the virtual property attributes of private key and ETH,and take the theory of substantive preparatory crime as the basis for punishing smart contract at the preparatory stage.
