The right to data portability is an emerging right arising from data circulation,which is of great sig-nificance to strengthen personal data protection and release the vitality of competition.China's Personal Infor-mation Protection Act only provides the basic principle of the right to data portability,and it is necessary to study the implementation path of the principle.The EU and the United States have accumulated certain experi-ence in implementing the right to data portability,which may provide a reference for China to implement the right to data portability in practice.It is suggested that China should follow the modesty principle and promote the implementation of data portability by considering the specific rules and the application field so as to provide a guarantee for protecting data flow and personal information.
