The Predicament and Improvement of Antitrust Regulation on Big Data Business Model:From the Perspective of Dominant Market Abuse
The new round of technological and industrial revolution represented by digital technology has brought challenges to the enforcement and regulation of competition order.On one hand,the Data Feedback Loops effect has strengthened economies of scale and network effect.On the other hand,under the influence of the big data business model,the exclusive transactions and exploitative pricing practices of platform operators with the ability to control data have disturbed the fair competition mechanism.Therefore,it is necessary to op-timize and improve the analytical framework of the antitrust law so that the definition of the relevant market is not bound to specific analytical tools,and non-price factors such as data control capality are included in the defi-nition parameters while the limitation of personal privacy as an analytical tool needs to be clarified.This will en-able the antitrust law to adapt to the changing needs of society and to fully demonstrate its adjusting,balancing and governing effects in the era of digital economy.
