摘要
我国高校科技成果拥有量逐年上升,而成果转化率却不尽人意.造成科技成果数量与转化率不成正比的因素是多方面的,在现行法律框架下转化主体面临多重知识产权法律风险,高校科研人员即使作为赋权后的成果所有权人仍然"放不开手脚".主要的知识产权法律风险包括:确权过程中的权属分割风险、产权交易过程中的价值评估风险以及产权保护过程中的泄密风险等,只有针对性地防范法律风险,才可以最大限度发挥高校在科技创新上的优势.同时发挥政策优势,加快构建知识产权管理体系,对各流程产权以规范管理的方式进行保护.
Abstract
The quantity of science and technology achievements in our country increases year by year,but the conver-sion rate is unsatisfactory.There are many factors that cause the rate of scientific and technological achievements is not proportional to the conversion rate.Under the current legal framework,the conversion subject faces multiple legal risks,which leads to the scientific and technological personnel in colleges and universities,even as the owners of the achieve-ments,still have their hands tied.The main legal risks include:the risk of ownership division,the risk of value evaluation and the risk of disclosure,etc..Only by preventing legal risks,can universities maximize the advantages of scientific and technological innovation.At the same time,give full play to policy advantages,accelerate the construction of intellectual property management system,and protect the property rights of each process in a standardized management way.
