摘要
经济特区立法变通权的合理行使将有效提升两岸融合发展示范区建设的法治保障水平.经济特区立法变通权应用于涉台事务,是因应对台开放的特定时代背景、探索"一国两制"台湾方案制度落实的切入点以及正确处理中央与地方关系的需要.从立法变通的授权范围、技术支持维度以及社会基础层面考察均具有充分可行性.经济特区立法变通权将发挥制度示范、规范对接以及风险规制的独特作用,为妥善解决涉台问题提供法理支持.为有效探索海峡两岸融合发展新路及建设两岸融合发展示范区,适当拓展立法变通权的被授权主体、贯彻全过程人民民主监督、确立变通性立法审查标准、借鉴粤港澳区域法治经验,是经济特区涉台事务立法变通的应然路径.
Abstract
The reasonable exercise of the legislation accommodation power of special economic zones can effectively improve the level of legal protection for the construction of The Cross-Strait Integrated Demonstration Zone.The application of legislation accommodation power of special economic zones in Taiwan-related fields is the entry point to meet the special background of opening to Taiwan and to explore the implementation of " One Country,Two Systems" Taiwan Plan,and is also the need to correctly deal with the relationship between the central government and the local government.It has full feasibility from the aspects of the scope of the legislation accommodation power,the dimension of technical supports and the part of social base.The legislation accommodation of special economic zones will specifically play its unique role in system demonstration,normative docking and risk regulation,providing a legal basis for properly solving Taiwan-related issues.In order to effectively explore a new path for cross-Strait integrated development and build The Cross-Strait Integrated Demonstration Zone,it is necessary to appropriately expand the authorized subjects of legislation accommodation power,implement people's democratic supervision of the entire process,establish flexible legislative review standards,and rationally draw on the experience of Guangdong,Hong Kong,and Macao,which should be the path for the legislation accommodation power of Special Economic Zones in Taiwan-related fields.
