两岸工伤保险制度比较及衔接路径

随着两岸交流交往日益密切,两岸劳动力流动必将成为趋势.实现两岸工伤保险制度有效衔接是便利两岸人员往来、保障流动劳动力工伤保险权益的必然选择.两岸工伤保险制度均经历了从综合性社会保险制度的一部分演变为专门制度的发展历程,并遵循长期待遇和短期待遇相结合的原则.但由于经济社会发展情况不同,两岸工伤保险制度在参保对象、保费缴纳、工伤认定、劳动能力鉴定、待遇给付等方面共性与差异性并存,为两岸制度衔接带来机遇与挑战.应充分挖掘两岸工伤保险制度的共同点,建立两岸工伤保险互认和管理制度,搭建两岸工伤保险交流协作平台,有计划分阶段实现两岸工伤保险制度的有效衔接.
Comparison and Pathway for the Integration of Industrial Injury Insurance Systems across the Taiwan Straits
As cross-Strait exchanges become increasingly close,cross-Strait labor mobility will inevitably become a trend.Realizing the effective connection of the cross-Strait work-related injury insurance systems is an inevitable choice to facilitate cross-Strait personnel exchanges and protect the work-related injury insurance rights and interests of mobile labor.The work-related injury insurance systems on both sides of the Straits have experienced a development process from a part of the comprehensive social insurance system to a special one,and follow the principle of combining long-term and short-term benefits.However,due to different social backgrounds and economic development conditions,the cross-Strait work-related injury insurance systems have both commonalities and differences in terms of insured persons,premium payment,work-related injury identification,labor capacity assessment,and benefit payment,which brings opportunities and challenges to the connection of the cross-Strait systems.We should fully explore the common points of the cross-Strait work-related injury insurance systems,establish a cross-Strait work-related injury insurance mutual recognition and management system,build a cross-Strait work-related injury insurance exchange and cooperation platform,and plan and implement the effective connection of the cross-Strait work-related injury insurance systems in steps.
