Analysis of Copyright Filtering Obligations in the Short Video Industry in the Web 3.0 Era
In the context of the Web3.0 era,short video platforms have transformed from simple service neutrality to content service assistance with the development of digital technology.From a normative perspective,the traditional"notification-delete"rule has not only become an excuse for platforms to abuse and evade responsibility,but also shows a clear mismatch between the development of the short video industry and rule governance due to the characteristics of passive waiting and post protection.Therefore,the key to resolving this conflict is to introduce content filtering obligations.Through in-depth argumentation of the legitimacy of filtering obligation rules,it is suggested that not only prefiltering obligations should be introduced,but also it should be combined with post protection rules to form an industrial protection chain,fully leveraging the effectiveness of pre-protection and post-protection.Finally,while drawing inspiration from EU legislation and taking into account China's actual sit-uation,China need to re-examine industry responsibilities to create a digital business environment,and propose a layered transi-tional prefiltering scheme that not only applies hard law protection but also uses soft law shaping,in order to explore new paths for short video industry governance research.
