Scientization of judicial proof and substantialization of people's assessor system——Promoting the technical path to"trial-centralization"reform
The development of the people's assessor system offers a viable path to the promotion of the"trial-centralization"reform.However,both the trial-centralization reform and the people's assessor system reform are confronted with a circular argument dilemma.From the perspective of judicial proof,the path to scientific judicial proof,which is a technical approach,can be used not only to enhance the practical implementation of the people's assessor system,but also as a focal point in the"trial-centralization"reform.In China,it is necessary and feasible to implement scientific judicial proof in the judidcial practice.A technical path to reform,the focus of which is the method of judicial proof,will become plausible,given that the following three aspects of efforts are put into practice:the accurate implementation of the limited scope,the establishment of diverse methods for judicial proof within the two litigation patterns,and the clarification of the procedural rules of scientific judicial proof.
