Due to the remarkable characteristics of the digital economy,inclusive of network effects,economies of scale and big data,the big Internet platform obviously has the trend to be monopoly or oligopoly,so that there is a call to strengthen anti-monopoly regulation in this field.The EU Digital Market Act(DMA)is the first one to regulate digital economy through ex ante per se obligations,and there may be some other jurisdictions considering the Brussels effects.In China,there are also some scholars encouraging to introduce this EU model to regulate Chinse Internet platform market.However,learning from foreign legal systems,should consider the national conditions.Whether China needs to adopt the EU model,should not only e-valuate the status quo and the prospects of the implementation of Anti-Monopoly Law in this field,but also consider whether a package of ex ante will help the development and innovation of Chinese digital economy.
