系统观念是具有基础性的思想和工作方法.系统观念和系统思维也能够为劳动法典提供基础性的编纂思路,即以整体性把握法典的总体架构,以结构性布局法典的篇章体例,以层次性确保法典的效力等级,以开放性保持法典的伸缩之力.劳动法典的编纂思路应遵循系统思维,渐进优化劳动法典的内容,构建竞争与协同发展的劳动关系模式,及时回应社会诉求,关注新兴问题并进行类型化处理.劳动法典的立法路径选择要立足劳动法自身演进规律,以编纂式劳动法典为立法模式,加强与其他部门法的系统链接,以单行法和政策保持劳动法典的系统开放,促进劳动法典确定性与灵活性相结合.
The system conception is a basic ideology and working method.The system concep-tion and system thinking can provide the basic ideas for compiling Labor Code,that is,to grasp the overall structure of the code as a whole,to designs the format of the Code in a structured manner,to ensure the effectiveness of the Code with a hierarchy,and to maintain the flexibility of the Code with openness.The compilation of Labor Code should follow systematic thinking,gradually optimize the content of Labor Code,build labor relations of competition and coordinated development,respond to social demands timely,pay attention to the emerging problems,and deal with them in a typological manner.The choice of the legislative path of Labor Code should be based on the laws of evolution of Labor Code itself,take the codified Labor Code as the legislative model,strengthen systematic links with other sectoral laws,and keep Labor Code system open to separate laws and policies to promote a combination of certainty and flexibility in Labor Code.
