Why should legal studies shift from examining algorithmic power to investigating dig-ital power?By observing the impacts of digital technologies in both commercial and governmental con-texts,one can discern the emergence of digital private power and digital public power,which are po-sing widespread societal risks that threaten human rights and redefine the rule of law.As a novel form of power,digital power is characterized by its legal nature at both factual and normative levels,ne-cessitating its inclusion within the realm of legal studies and subsequently within the legal conceptual framework.While subject to the governance of the rule of law,digital power has the capacity to over-come the inherent shortcomings of the human rule of law,enhance human rights and the rule of law,and ultimately contribute to the betterment of humanity.It is based on this logical premise that the digital rule of law assumes a clear and distinctive mission to utilize digital power in shaping a future rule of law that is able to be"empowering and promoting goodness".
