The prerequisite for regulating the design of specialized courts lies in clarifying the operation logic of the specialized court system.Analyzing the process of the establishment and evolu-tion of China's specialized court system,it is found that its operation logic includes judicial logic,logic of the rule of law,political logic and economic logic.The lack of specialized judicial facilitation and systematization,the contradiction between the unity and stability of the rule of law and the flexi-bility of policy promotion,the limited function of specialized courts,and the tension between benefits and costs,have become the limited factors on the realization of the operation logic of the specialized court system.By building an inclusive and systematic specialized judiciary,promoting the internal and external unity of the rule of law principle,ensuring the cross provincial administrative layout un-der major national strategies,and centralizing the"cost-effect"measurement method,we can re-solve the contradictions in the operation logic of the specialized court system.The future design of China's specialized court system needs to promote the standardization of the establishment system of the specialized courts,the clarity of the jurisdiction system and the scientific management system.
