There are two typical paths of private law regulation of algorithms,which are the sce-nario-based path and the domain-oriented path.The scenario-based path is based on considerations of applicable environment and focuses on the present.The domain-oriented path is based on consid-erations of norm systems and focuses on the future.Both are committed to responding to the challen-ges posed by technological breakthroughs of algorithm.The algorithm is a decision-making mecha-nism of human-computer interaction,and humans choose an algorithm as a decision rule embedded in the expression of intent,thus completing the arrangement of personal affairs.The normative princi-ple of the private law regulation of algorithms is that the algorithm functions as a unique communica-tion structure inside,and plays a dual interface function outside,which determines that the algorithm can affect the content of the subjective will of the civil subject to different degrees.Accordingly,the regulation of algorithms in private law should also be based on the classification of algorithms,then completing the systematic construction of algorithm norms community.According to the different mechanisms by which algorithms affect the expression of intent,algorithms can be divided into com-municative algorithms,inductive algorithms,corrective algorithms,and driving algorithms.The pri-vate law regulation path of algorithms can also be based on the classification,with Civil Code as the core,to integrate the norms community of interpretation and validity of algorithms.
