"双碳"目标下我国碳抵消机制的法律保障创新研究

碳抵消机制是应对气候变化领域的新生事物，其为我国碳排放配额交易市场的重要补充。在实现"双碳"目标下，我国碳抵消机制的法律保障是确保我国碳排放权交易市场稳定的重要问题。文中研究发现，我国碳抵消机制中碳减排量的法律属性不明、政策指导下碳抵消机制规范性与系统性不足以及碳减排量交易市场拓展受限等问题，阻碍我国双碳法治建设与碳交易市场的稳定有序。在积极稳妥推进碳达峰碳中和战略的时代背景下，通过分析我国碳抵消机制法律保障的必要性，从规范与学理层面明确碳减排量的用益物权属性，构建体系化的碳抵消机制法律制度。同时，确立多元化碳减排量权利主体共有制度，搭建全国统一的市场交易平台，以稳定碳减排量市场交易价格，并形成有效的市场监督框架，有序拓展我国碳减排量交易市场，完善我国碳排放权交易市场，向碳中和乃至净负排放稳定过渡，逐步健全能源安全与气候安全法律体系。
Legal protection innovation for China's carbon offset mechanism under the"dual carbon"goal
A recent development in fighting against climate change is the carbon offset mechanism,which is a crucial supplement to China's carbon emission quota trading market.The legislative protection of China's carbon offset mechanism is an important issue to ensure the stability of China's carbon emission trading market in achieving the"dual carbon"goal.The study discovers that some issues such as uncleared legal definitions of carbon reduction emissions in China's carbon offset mechanism,insufficient standardization and systematicity of carbon offset mechanisms under policy guidance,and the limited expansion of carbon emission reduction trading markets hinder the development of'dual carbon'legal system and a stable and orderly carbon trading market in China.The usufruct attributes of reducing carbon emissions are clarified from the normative and academic levels,and a systematic legal system of carbon offset mechanism is constructed against the backdrop of actively and steadily promoting the strategy of carbon peaking and carbon neutrality and by analyzing the necessity of legal guarantee of China's carbon offset mechanism.Then,we propose some suggestions to establish a diversified system of co-ownership of carbon emission reduction rights entities,build a nationwide unified market trading platform to stabilize the trading prices in carbon emission reduction in the market,and form an effective market supervision framework,expand China's carbon emission reduction trading market in an orderly manner,improve China's carbon emission trading market,make a stable transition to carbon neutrality or even net negative emissions,and gradually improve the legal system for energy security and climate security.
