Jurisprudential interpretation and path optimization of biological invasion prevention and control from the perspective of collaborative governance
Collaborative governance has become the underlying logic and critical point for constructing the legal system for biological invasion prevention and control in China.Utilizing various methods such as normative research,literature research,inductive reasoning,and comparative analysis,this study systematically examines the legal system and rule-of-law challenges of biological invasion prevention and control based on the relationship between the prevention and control of biological invasion and collaborative governance.The study reveals the following findings:In the regulatory dimension,the basic legal framework for biological invasion prevention and control has been established,but the systemic challenges such as structural fragmentation and lack of value coherence persist.In the dimension of subjects,there is a lack of coordination among cross-departmental and cross-regional governance entities,and insufficient participation from diverse governance acts.In the system operational dimension,some prevention and control mechanisms are incomplete,and there is inadequate integration among existing systems.In the responsibility dimension,issues such as singular forms of responsibility,unclear application rules,and poor linkage of responsibilities remain.Based on these findings,this paper proposes several recommendations:enhancing the coherence of the regulatory framework,promoting communication and collaboration among diverse stakeholders,ensuring the orderly operation of the institutional system,and rationally allocating legal responsibilities.
