Supplementary Functions of Private Entities in the Governance of Cross-border Data Flow:Generation Logic,Participation Path and Implication
In the era of digital economy,the object characteristics and the changes in governance structure of cross-border data flow have led to the changes in its governance foundation.Private entities have the coordination willingness and technical ability to respond to the governance needs in this field.They indirectly promote the convergence of regulatory rules,participate in shaping technical standards and integrate into the legal process led by traditional governance entities,achieving supplementary functions for the governance of cross-border data flow.However,the current path of private entities'participation in governance also has limitations.Therefore,China should not only regulate the participation of private entities in the governance of cross-border data flow,but also lay a solid institutional foundation for improving their governance capabilities and explore feasible paths to leverage the supplementary governance functions of private entities externally,thereby promoting the international governance level of China's participation in shaping cross-border data flow mechanisms.
