Digital Governance Risks of Very Large Platforms and Response in the EU's Law
The very large platforms abuse their power in digital content governance and make unfair terms in platform guidelines and user service agreements,manipulating platform information through content and advertisement presentation and restricting the users'remedies in disputes.The legislation on network intermediary liability characterized by ex post liability regulation cannot redress such problems.Hence,Digital Services Act of the EU imposes strict proactive obligations including information disclosure,systemic risks evaluation and mitigation and dispute settlement mechanism improvement,solving the internal problems of digital content governance of very large platforms and urging them to develop the motive of improving content moderation.The platform law in China requires the platforms to shoulder the general liability of content moderation,but the provisions on the obligations of platforms do not have specificity for very large platforms and lack proactiveness.It is feasible to refer to the provisions of Digital Services Act of the EU on the obligations of information disclosure,systemic risks prevention,prudential content moderation and user remedie21s of very large platforms to restrict their abuse of governance power.
