Cross-border Flow of DEPA Data:Regulatory Differences and China's Response
At present,it is a critical period for the construction of global digital trade rules and how to regulate cross-border data flow is the core issue.The rules of DEPA which is a new representative of digital governance mode are forward-looking,open and inclusive,and have significant impact on global digital trade governance pattern.Joining DEPA has certain strategic value for China.In practice,China's regulation of cross-border data flow,including RCEP and domestic laws,is inconsistent with DEPA rules to a certain extent.To this end,China should adhere to the concept of cooperation and inclusiveness,explore high-standard and high-level cross-border data flow rules from three aspects of building diversified jurisdiction,exploring free trade zone(port)system and enhancing the joint construction of the Belt and Road,so as to achieve the convergence with DEPA rules,improve the"Chinese template"of digital governance and contribute China's wisdom to the construction of a unified global data governance pattern.
