总体国家安全观视域下,加强智慧养老服务数据安全治理,提升数字经济时代的数据价值,是完善我国数据安全体系建设和促进智慧养老服务发展的应有之义.本文以"实然困境、应然定位、治理策略"为思路,对相关风险进行类型化总结并追本溯源.在明确大数据时代老年人数据安全的法理基础与技术困境、人口老龄化社会中老年人数据权益的代际正义困境、多元化数据主体的数据安全博弈以及协作治理困境后,重塑智慧养老服务数据安全治理理念,确立其应然定位.基于此,通过智慧养老服务数据安全风险评估机制、智慧养老服务数据全生命周期监管体系、区块链赋能智慧养老服务数据安全监管和智慧养老服务数据安全治理法律责任制度,探索监管创新之路.
Data Security Governance of Smart Elderly Care Services:Concept Reshaping and Supervision Innovation
From the perspective of overall national security,strengthening the data security governance of smart elderly care services and enhancing the value of data in the era of digital economy is the proper meaning of improving the construction of our country's data security system and promoting the development of smart elderly care services.Based on the idea of"actual dilemma,proper positioning,and governance strategy",this article summarizes the relevant risks by type and traces back to the source.After clarifying the legal basis and technical dilemma of the data security of the elderly in the era of big data,the intergenerational justice dilemma of the data rights and interests of the elderly in an aging society,the data security game of diversified data subjects and the dilemma of collaborative governance,reshaping the smart elderly care service concept of data security governance,establishing its proper positioning.Based on this,by the smart senior care service data security risk assessment mechanism,the smart senior care service data full life cycle supervision system,the blockchain empowerment of smart senior care service data security supervision,and the smart senior care service data security governance legal responsibility system,exploring the road of regulatory innovation.
