Framework and characteristics of Japanese legal system related to mining
This article aims to sort out the framework of Japan's mining related legal system and analyze its legislative characteristics.Using research methods such as literature collection,static analysis,and comparative research,it summarizes the basic situation of Japan's mining related legal system,sorts out Japan's mining related legal system,and analyzes and studies the legislative characteristics of Japan's mining related legal system.The research results indicate that:① Japan has 11 categories of legislation,among which the relevant laws related to mineral resources and energy are mainly divided into three parts:Japanese industrial law,environmental law,and administrative law;② Its legislative characteristics are to attach importance to mine safety,intensive and energy-saving utilization of resources and energy,and ecological protection,with legislation to ensure the"open source,throttling,and reserve"of resources and energy;③ A legislative system that complements laws,regulations,and rules forms a closed-loop legal system for the implementation,evaluation,adjustment,and modification of legislation.Research conclusion:Drawing on the legislation of Japan's seabed mining industry and special legislation related to mine safety,metal tailings extraction,and ecological environment management,with the main legislative considerations of promoting geological exploration,standardized mining of resources and energy,and scientific management of the entire industry chain,we will refine and improve China's mining related legal system,ensure the safe supply of resources and energy,and conserve and intensively utilize them.
