The rapid development of artificial intelligence generated content(AIGC)brings structural and fundamental changes to traditional judicial models,making it crucial to examine and analyze the process of empowering these models.In the era of intelligent justice,though AIGC has positive implications in empowering smart to enhance the efficiency of smart courts,accelerating the integration of technology and justice,and promoting the improvement of judicial personnel's skills,it also presents risks such as challenges to the principle of judicial power impartiality,insufficient judicial evidence,algorithmic discrimination,and algorithmic black box.To figure out the specific reasons behind the dilemmas faced in AIGC empowering judicial construction,it is proposed to focus on the inherent limitations of AI technology,the power attributes of technology,and the weak labeling of case data.Based on this,suggestions including enhancing the technical control capability of the judicial system,ensuring the interpretability of algorithmic decisions,establishing a unified modern database of judicial cases,and promoting interdisciplinary training of legal professionals are put forward.These targeted recommendations aim to facilitate the modern development of China's judicial technology integration and fully harness the capabilities of AIGC empowering smart justice.
