Empirical Study on Reform of Corporate Compliance in Involved Enterprises:a Case Analysis Using Survey Data from Five Districts and Counties in T City,Zhejiang Province
The reform of corporate compliance concerning involved enterprises in China has entered a challenging phase,with o-verall stability and improvement in compliance practices.However,there are still issues and deficiencies in various aspects,such as the practical implementation,mechanism operation,supervision and review,enforcement coordination,and judicial collaboration.The reasons behind these challenges involve multiple levels,including legislative policies,institutional frameworks,system support,and key stakeholders.Therefore,it is necessary to focus on the realities of China's national conditions and continuously promote the com-bination of standardized design and practical experimentation.This includes refining criminal integration legislation for corporate com-pliance,leveraging existing criminal law resources,establishing differentiated and dynamic mechanisms for reforming compliance in involved enterprises,addressing shortcomings in third-party mechanisms,and ensuring effective regulatory oversight.Efforts should be made to enhance the system efficiency of enforcement cooperation and judicial collaboration,facilitating the comprehensive devel-opment of a prosecutorial-led,China-specific judicial system for compliance in involved enterprises,which encompasses industry compliance and full-cycle compliance in criminal justice.
