Improvement Path for the Investigation and Verification Right in Civil Public Interest Litigation by Procuratorial Organs
The right of investigation and verification of public interest litigation is in line with the constitutional status of the procuratorial organs and the function of safeguarding the public interest,which is related to the realization of the goal of public interest litigation,and has the necessity and legitimacy.The protection of public welfare from infringement must be based on the state coercive force.The investigation and verificationright of civil public interest litigation by procuratorial organs is too flexible in the process of judi-cial practice.In case of the obstruction or refusal to cooperate with the investigation,it is difficult for the procuratorial organs to im-plement timely investigation,collect and verify the evidence materials involved in the case.Therefore,the procuratorial organs should timely issue social governance procuratorial suggestions based on the operational needs of the investigation and verification right,appro-priately expand the scope of application of public interest litigation procuratorial suggestions,explore the establishment of an integrated prosecutorial civil public interest protection injunction system,and quickly stipulate mandatory measures that hinder prosecutorial civil public interest litigation,thereby improving the protection mechanism of prosecutorial civil public interest litigation investigation and verification right.
