Criminal Law Regulation of Web Crawlersfrom the Perspective of Criminal Compliance
Malicious web crawlers pose a criminal risk of infringing on the legal interests in data,personal information and copyright protected by criminal law,and it is necessary to regulate them through criminal law.Faced with the constantly expanding criminal law risks posed by web crawlers,the criminal law regulation must impose restrictions on three levels of data crawling methods:breaking through technical protection measures,data crawling types being open data,and data crawling types being illegal data.Therefore,introducing the concept of criminal compliance and establishing specialized compliance rules to regulate data collection,personal information,and copyright content crawling can balance crime crackdown and data circulation.By limiting the criminal liability of web crawlers for crawling data,stipulating the penability for crawling public personal information,and determining the pen-ability for crawling copyrighted content,we aim to improve the criminal law regulation of web crawlers.
