Dispute and Solution:Research on the Inheritance of the Right to Use Homestead
Although the Supreme People's Court of the People's Republic of China.The Ministry of Natural Resources of the People's Republic of China,and other departments have issued policy documents supporting the inheritance of the right to use homesteads,local policy documents have also been issued to regulate this inheritance.However,due to the lack of specific laws,limitation on the identity of the inheritance subject,and the absence of compensation and unlimited obstacles,the question of whether the right to use homesteads can be inherited ramains controversial The academic community has also discussed and studied this issue.To resolve the dilemma surrounding the inheritance of the right to use homesteads,we can resolve the problems from multiple angles,perfecting legal provisions,clarifying the identity and inheritance rules for the inheritance subject,and improving the system of the right to use homesteads.This will help to implement the idea of activating the right to use rural homesteads in the policy of"separation of the three powers".
