"三治合一"乡村治理法治体系构建研究

摘要
"三治合一"治理体系源自对乡村治理实践经验的系统总结与提升,囊括了 自治系统、法治系统、德治系统等不同治理系统.乡村振兴是国家治理体系和治理能力现代化在乡村层级的集中表现,是健全乡村共建共治共享社会治理制度的关键支撑,是提升乡村社会治理效能的重要抓手.乡村治理共同体是融合自治、法治、德治三要素的"三治合一"的共同体,乡村治理共同体的核心要素是"人人有责、人人尽责、人人享有",充分体现了人民性、协同性和共享性的特质.《民法典》为乡村治理提供法律保障,《民法典》的绿色原则是乡村治理的基本原则,乡村振兴的最终目的是要实现农民的合法权益."三治合一"乡村治理体系的生成与运行机制包括:"三治合一"乡村治理体系的生成机理,"三治合一"乡村治理体系的善治运行,"三治合一"乡村治理体系的优化创新.构建"三治合一"乡村治理法治体系的主要路径是:构建完善新时代乡村社会治理共同体,健全乡村社会治理的地方立法体系,建设法治乡村的质量评价评估体系.
Abstract
The"Three Governances in Oneness"governance system originates from a systematic summary and improvement of rural governance practice experi-ences,including such governance systems as self-ruling system,legal sys-tem,and moral system.Rural rejuvenation is an embodied display of mod-ernization of national governance system and capability at the rural level as well as a key support for consolidating the rural jointly constructed,gov-erned and shared social governance system,and an important catch-point for the improvement of rural social governance efficacy.The rural govern-ance community is one integrating self-ruling,legal ruling and moral rul-ing,that is,a community of"Three Governances in Oneness",whose core element is"everyone has a responsibility,everyone should fulfill it,and eve-ryone enjoys it",thus showing the features of people orientation,coordina-tion and sharing.The Civil Code provides legal guarantee for rural govern-ance,its green principle is the basic principle for rural governance,and the ultimate goal of rural rejuvenation is the realization of farmers'rightful ben-efits.The generation and operation mechanism for the"Three Governances in Oneness"rural governance system includes the generation mechanism,the good-ruling operation,and the optimized innovation.The major paths for the construction of the legal system for the"Three Governances in One-ness"rural governance are the development of improved new era's rural so-cial governance community,the consolidation of local legislation system for rural social governance,and the building of quality evaluation and assess-ment system for rural legal ruling.
