Analysis on the Value of Customary Law in the Protection of Intangible Cultural Heritage
The intangible cultural heritage itself contains rich content of customary rules,which play an irreplaceable role in cultural inheritance compared with formal norms.These customary rules are orally transmitted and executed by habit institutions in accordance with the cultural values of traditional communities and groups,aiming to protect the social and cultural interests of intangible cultural heritage and ensure equal rights and obligations for members within the group.According to traditional customs,the intangible cultural heritage is collectively owned,and its use ethics rely on customary rules and social relations within the group.Customary rules play a crucial role in protecting collective rights.The customary rules that have been followed for many years are closely linked to the regions and groups where the intangible cultural heritage is located,and coexist complementarily with modern rule of law,working together.In terms of the values of protecting intangible cultural heritage,the consistency of the two can make them echo each other and jointly maintain the inheritance and development of intangible cultural heritage.
